Loophole Prevents Removal of Lake County Councilman Will Smith

Neither State Attorney General Steve Carter nor Lake County Prosecutor Bernard Carter are able to remove Lake County Councilman Will Smith, a recently convicted felon, from his seat on the Lake County Council due to conflicting laws on the books. Both men have asked Smith to resign and urged the council to censure him.

"Does the (county) council really feel it is necessary for them to continue to allow this individual to serve and continue to use taxpayer funds to support that service? It certainly is legally questionable," Steve Carter said. Bernard Carter concurred.

State Senator Frank Mrvan is working to correct the law but the General Assembly does not reconvene until Jan 8th, one day before Smith is due to be sentenced.

That leaves the County Council but they have refused to act:
Council President Elsie Franklin, D-Gary, said she cannot afford to lose Smith.

"I need his expertise and dedication," she said.

That must be one of the most ridiculous things that I have heard in quite a while. What does that say about her feelings toward the other council members?

Since Mr. Smith refuses to do the right thing and resign, the County Council needs to censure him. Since they have refused to do so, they have also betrayed the public trust. In my mind, they are no better than Mr. Smith and do not deserve to sit on the County Council. And they wonder why Lake County has such a bad reputation in state government.

In the meantime, may I suggest calling the County Council office in the government center and demand the council censure Smith.
